THE BLACK MAN’S HISTORICAL LEGAL ARGUMENT

THE BLACK MAN’S HISTORICAL LEGAL ARGUMENT

I have at times been engaged in debates with Eurocentric white supremacist mindsets and reactionary Negro mindsets about racism, reparations, slavery, freedom and our quest for social justice. Many of them make every attempt to dismiss the so-called African American historical suffering and injustices under white America (tentacles of white supremacy) as something of the past and we should just forget about this tragedy and allow us as a nation to move forward towards racial harmony and national healing (I often refer them to Dr. Joy DeGury's book titled, Post-Traumatic Slave Syndrome) in which she maintained that so-called African Americans were never permitted to heal and we are presently living our lives as victims in trauma some 400 years later. My mind leads me to think about the profound book authored by Randal Robinson titled, The Debt: What America Owes to Blacks, which gives us a picture of how this country was built by African slaves, our intellect, resilience and unrewarded labor that constituted our blood, sweat and tears which laid the foundation of the United States—this debt has never even been acknowledged or repaid. It is coded in my blood and my DNA to remember the African/black Holocaust and the dehumanization affect Chattel slavery has had on the collective consciousness of my people of African descent (this criminal event made us a dispossessed and marginalized people, although, we are over 160 years removed from the actual experience). This is why I have always applauded our social-psychologists such as Amos Wilson who authored the book titled, A Blueprint for Black Power a Moral, Political and Economic Imparative for the Twenty-First Century and Dr. Naim Akbar, Chains and Images of Psychological Slavery.

I have also always applauded the historical liberation work of Martin Delaney, Henry Highland Garnet, Paul Cuffee, Marcus Garvey, Bishop McNeal Turner, Drew Ali, etc.—they had it right.  The only solution to ever ending this racial social disharmony and divisiveness inside America is the eradication of white denial and a dispersing of justice for the so-called American Negro (reparations must be apart of this discussion without this there cannot be any atonement or reconciliation)—no civil rights legislation and not even an elected body of fifty plus Negroes in the U.S. Congress (Congressional Black Caucus) they don't possess the ability or political wither-all to resolving our historical and present dilemma (they think with a slave mentality). Thus, they have no real political lobbying influence and power to put forth the black agenda and are to fearful of truly lobbying on behalf of so-called Africans in America and throughout the disapora (these Negroes only lobby for the crumbs that falls from the rich man Lazarus' table). They do not have the power of the pharmaceutical industries lobby, National Rifle Association lobby, Military Manufacturers and the military industry lobby nor the Jewish Lobby, which to mold and shape public policy in the interest of black people.

White America is quick to make the assessment that if you are dissatisfied with America, why don't you leave? We did not asked to come here my ancestors were brought to these shores against their will (America is our exiled home). I do not mind leaving America, but I often have to remind them that they are not in a moral or legal position to evict me and us off the indigenous people's lands—the Native Americans are our brothers and sisters, and are the only true landlords over the Americas.  But before I/we leave there are some poignant conditions and unfinished business, which must start with calculating 310 years of owed reparations that must be attached to our human suffering, and while you at it calculate the past owed interest on the slave debt (@ 25% on the dollar).  Then multiply this owed gross amount in the area of pain and suffering (what happened to the black man and black woman cannot have a monetize value, the damage is beyond dollars and cents). Also, have the Bank of England and the U.S. Federal Reserve Bank to wire transfer my/our owed monetary debt in Yuan Renminbi currency (Chinese dollars) and deposited it in a Swiss bank (Basil or Geneva) account. And while they are at it petition the United Nations and World Court and turn yourself into the Hague Tribunal (Hague, Netherlands) in order to be charged with war crimes against humanity; do not forget to travel the slave routes of the Transatlantic Slave Trade and Middle Passage and bring as much sage that you can transport and be prepared to burn sage over the Atlantic ocean for next 100 years and give my people the proper burial (what is happening to you all is their souls and spirits are haunting you politically, economically and socially; this was the beginning of our trail of tears—Marcus Garvey said look for me in the world wind). Lets not stop there by first turning yourselves into the custody of U.S. Federal courts and eventually from there may be will transport you to an Islamic country where Sharia is the law. These are my conditions for leaving.

Just as Minister Malcolm X stated in 1960s they are good at making the victims the criminals, and the criminals the victims. The Europeans have decimated the entire African continent (and the globe) based on imperialism and colonialism. They have destroyed Africa's political, social and economic structures and disrupted its cultural continuity as a people (the Berlin Conference in 1884-1885 led to the partitioning of Africa, which divided the continent into little nation-states in order to serve the exploitive interest of the European powers--King Leopold ll opened the conference up in the name of God ). They are still there on the continent of Africa under the auspices of the World Bank and the International Monetary Fund (IMF) (two of the global rogue International banks) exploiting the natural resources and propping up corrupt dictatorships who work and serve in the interest of Western Europe (neo-colonialism)—I trust President Robert Mugabe of Zimbabwe over the negative propaganda being reported against him by western media (he rightfully redressed African people's land and territory that were stolen by European settlers under Ian Douglas Smith and prior white colonial masters). I cannot forget the inhuman slaughtering of Africans in the diamond mines carried out by Cecil Rhodes in Zimbabwe in the name of capitalism. Europe and Europeans as I have stated above owes Africans on the continent and throughout the Diaspora a great debt.

When the Europeans settlers (the dregs of Europe) in the 1600s arrived to the Eastern Seaboard to what they called the ‘New World’ Christopher Columbus in 1492, was actually lost when he landed on the Caribbean Island of Hispaniola in which the Native Americans (Carib and the Arwak) were there sixteen thousand years before Columbus arrival and what eventually would be called the United States of America—there were two million Native Americans so-called ‘Indians’ (indigenous original people) who were also victims of his practices of white supremacy and global genocide of the darker people of the earth. The Aboriginal people of New Zealand, Papua New Guinea and Australia were also victims of systemic practices of racism; the people of India and Asia were victims of his practice of global genocide.

But many who advocate that we are now living in a post-racial era (they were using the 2008 election of President Barack Obama, the first so-called black president as the measuring stick to positively quantify America's present day race relations). And desired to conveniently overlook these racist motivated historical crimes.
Perhaps the election of Donald J. Trump to the office of President, and him tapping into the real racial sentiments of America and appointing all of them ultra white nationalist to his cabinet, which may have shook us back to reality—America is a racist nation to its core.

This is why I have always kept black social issues in the forefront of my discussions and conversations; thus, my focus will always be on exposing and bringing greater awareness to the plight of so-called African people and to expose what took place with the original people because of the level of oppression and tyranny they have experienced; which as I stated above, it is often intentionally overlooked by Eurocentric thinkers and intellectuals. However, for me this isn't about race as much as it is about European and American imperialism—injustice that is what I am exposing (It just happened to be that the people who committed these above mentioned crimes and atrocities were Europeans).

I first met Dr. Michael Eric Dyson at the University of North Carolina at Chapel Hill in North Carolina in which he was upsetting white folk based on his so-called controversial scholarship (writing and speaking truth to power); Dr. Dyson has published a new book titled, Tears We Cannot Stop: A Sermon to White America. I have not read the book, but I recently saw Dyson talking about the book on CNN and as a public intellectual who often gives sound views on race issues and I am quite sure his recent analysis on race, class, white supremacy, Donald Trump, and on the present and future forecast will be timely.

No. I am not an American citizen, I am one of the 100 million victims of Americanism, my ancestors did not arrive to America on the Nina, Pinta nor the Santa Maria nor did we receive an immigration passport/visa or a green card. But we arrived in the hulls of slave ships (who were stolen from the Hinterlands and placed in slave dungeons at Elmina Castle off the coast of Ghana and Goree Island off the coast of Senegal) and did not receive an official welcoming from the Immigration Naturalization Services (INS). We did not get the opportunity to declare American citizenship like other so-called immigrant people who arrived at Ellis Island (off the Hudson River of New York and New Jersey) my ancestors arrived in chains as political prisoners. Where is the political asylum for the 400 year suffering and persecution of the ex-slaves, victims of the worst crime ever committed against humanity?

Andrew Hacker in his monumental book titled, Two Nations: Black and White Separate, Hostile, Unequal stated, “RACE HAS BEEN an America obsession since the first Europeans sighted "savages" on these shores. In time, those original inhabitants would be subdued or slaughtered, and finally sequestered out of view. But race in America took on a deeper and more disturbing meaning with the importation of Africans as slaves. Bondage would later be condemned as an awful injustice and the nation's shame, even as we have come to acknowledge the stamina and skill it took to survive in a system where humans could be bought and sold and punished like animals. Nor are these antecedents buried away in the past. That Americans of African origin once wore the chains of chattels remains alive in the memory of both races and continues to separate them”.

Hacker continues, “Black Americans are Americans, yet they still subsist as aliens in the only land they know. Other groups may remain outside the mainstream-some religious sects, for example-but they do so voluntarily. In contrast, blacks must endure a segregation that is far from freely chosen. So America may be seen as two separate nations. Of course, there are places where the races mingle. Yet in most significant respects, the separation is pervasive and penetrating. As a social and human division, it surpasses all others-even gender-in intensity and subordination.” (Reference: Andrew Hacker; “Two Nations: Black and White Separate, Hostile, Unequal” pg. 3).

The so-called African Americans must be properly educated about their history and the political and economic issues surrounding our sojourn and define for them who they were before the advent of slavery and the white man.  Chattel Slavery systematically made us blind, deaf and dumb to the knowledge of self. I am with my Moorish family quest and claim for a recognized nationality; however it must be based on us first knowing that our legacy and heritage (land rights) go much further back than the Europeans labeling us as Americans, black, Ethiopians, Negroes, Colored, African, African American, etc. I have an entire collection of various editions of Black’s Law Dictionaries in my library (we have to know and understand the legal definitions of 'black' and 'American' as defined by Black's Law Dictionary).

These false racial/ethnic labels allows for them to manipulate our sovereignty and nationality these so-called generic racial labels will continue to nullify our legal grievances to claiming our nationality, which compromises our lawful recognition as Moors (Muurs) a sovereign, independent and indigenous nation who were here before Atlantis disappeared and was geologically repositioned. We are the direct descendants of the ancient Moors (Muurs) and aborigines. This is perhaps the world's best kept secret that is now coming to light; Prophet Noble Drew Ali raised this point in early 1900s in which he tied our descent linage to the ancient biblical Canaanites and Moabites (the original Hebrews and Israelites were black).

The United Nations in my opinion, is a very important piece in our overall fight for recognition (which the theoretical foundation of our fight will always be rooted in our quest for freedom, justice and equality). The United States and the other European nations must be charged with violating the human rights of so-called African Americans who were the victims of 310 years of unjust brutality and our case one day by the grace of God will be heard in the U.N. Chambers of the Human Rights Commission in which Chattel slavery represented a war crime and crimes against humanity. Minister Malcolm X in 1965, was assassinated not by members of the Nation of Islam; the CIA and the FBI cannot escape culpability in brother Malcolm’s murder, because of his political intentions of taking our international grievances to the United Nations in order to charge the United States of being in violation of African Americans human rights (surely Minister Malcolm X had made a political transition and had moved beyond civil rights). Minister Malcolm X founded the Organization of Afro American Unity (UNIA), which to internationally advocate on behalf of the so-called African American, in particular after his suspension and departure from the Nation of Islam (this plank made Minister Malcolm X a dangerous man and set him on a collision course with the powers-that-be).

The enemy has always sent stool pigeons and agent provocateurs to derail the political, economic and social progress of progressive black movements and organizations. J. Edgar Hoover from the 1950s up until the 1970s utilized the F.B.I. counterintelligence program better known as Cointelpro where the United States Government systematically infiltrated black organizations and spied on its leadership such as: Paul Robeson, Kwame Ture, Jamil Al-Amin, Robert Williams, W.E.B. Dubois, Fannie Lou Hamer, Elijah Muhammad and the Nation of Islam, Malcolm X and the OAAU, Huey P. Newton and Bobby Seale and the Black Panther Party, Dr. Martin Luther King, Jr., and SCLC, A. Phillip Randolph and the labor movements, Imari Abubakari Obadele and Chokwe Lumumba of the Republic of New Afrika, etc.
We know that with the office of Homeland Security and the U.S. Patriot Act the internal surveillance relative to spying and intelligence gathering without legal warrants have been acerbated since 9/11, which allows government intervention (in violation of civil liberties) in the affairs of not just militant and radical groups and individuals but are even spying on ordinary citizens. They justify this in the name of national security interest and by labeling us Enemy Combatants.  Edward Snowden should be hailed as an American hero but when the governments use propaganda and disinformation they keep the masses confused and mentally discombobulated.

The above perspective layout an overview of the sinister and diabolical capitalist interest of how slavery and our forced captivity eventually turned us in to a commodity (agreed European property). Now, what our nation (Moorish nation, the so-called American Negro) is missing, was that our slavery status moved us towards a perpetual transition in 1913, with the establishment of two entities that would have the continued responsibility of serving and sanctioning our historical and illegal kidnapping: the Federal Reserve Act, and the Internal Revenue Service (keeps us in this legal bondage). These two entities assured that Unified Commercial Code (UCC) would forever define and link us to a present and historical status as being Chattel and/or property of the white man's USA corporation.

This will also allow the Dred Scott Decision (1857) and Missouri Compromise (1820) to forever on one hand mandate us as illegal aliens and yet dupe us into believing that the U.S. Constitution was ratified and that would later add the 13th, 14th and 15th Amendments to the United States Constitution, which so-called made us United States citizens and Americans (I do not think so).

They defined maritime law or International waters as having its own sovereignty and jurisprudence differs from Continental U.S. territories (these rules of law are uniquely different). So our legal signed agreement with the U.S. Corporation is our collective acceptance to continue to be defined by the above constitutional amendments and agreeing to participate in the affairs of the U.S. corporation.

But also as Moors (Muurs), we cannot have it both ways. If we understand the legality question of nationality and sovereignty (better than most so-called American Negroes), it places us in a very unique position.  We cannot continue to raise the most prolific and divisive symbol of our oppression, which is the American flag that stood for slavery, death and Christianity to the so-called American Negro. The American flag has no place in our religious and philosophical framework and ideology. If we are serious about creating a different set of freedom language lexicon and as we explore the legal definitions by using the science of etymology and epistemology to breakdown these non-binding and false racial identities applied to the so-called American Negro (we have to also challenge ourselves and our institutions).  Moreover, we can no longer raise the American and the United States flag in our Moorish Science Temples and meetings (as one of visible symbols and we cannot declare recognition of this republic or give credence to their nationhood by signing on to this).

I think in the early 1900s the Prophet Noble Drew Ali was concerned about using the best of intelligence by protecting the Moorish Science Temple from being attacked by the powerful United States Government and didn't want to subject his followers to being charged with sedition and treason and un-American activity. I think we have the responsibility of respecting the United States sovereignty, but not showing any patriotic allegiance to their flag or national anthem or any of their patriotic symbols

I am baffled that in 2017, the Moorish Science Temples of America simultaneously claim sovereign independency as Moorish Americans and to justify this contradictory and reactionary symbol known as the American flag by having it present in our places of worship; this is a sign of paying homage to our slave master's legacy—meaning his flag and his sovereignty, which in my opinion is illegal and unlawful. This symbol (in 1776 declared the United States by way of the Declaration of Independence a sovereign nation from British rule) was raised by the Europeans or the white man to justify his war crimes against us as Moors and under this flag he committed murder, genocide, land thievery, and led to the discretion of sacred edifices and holy lands in North America and South America. Much of it was legally belonging to indigenous Moors (in fact all of it).

If we refer to ourselves as "Moorish American" this represent a legal oxymoron and it compromises and deflates our overall legal position within the U.S. courts and the International courts. We should never allow ourselves to be referred and defined as hyphenated "Americans". No, I am not "Moorish American" and we should burn that damn American flag in our temples and throw it out and raise the sovereign flag of Allah, the Moorish God. I believe in complete sovereignty and I understand my nationality will not include any legal linkages to the term America or American. So that is the challenge that is confronting us as Moors (Muurs), if we are serious about changing the nationality paradigm and breaking the legal cycles of Chattel Slavery and declaring ourselves a free people.

Some of the American history that I have researched stated that only the six or seven original European settlers who settled as the Thirteen Original Colonies and those who stole the Americas would be classified as Americans and no indigenous people could ever be legally classified as "Americans". So once again we as Moors (Muurs) have to totally discard the American flag and trust in Allah, and move the Prophet Noble Drew Ali's principles and teachings to the next ether. The Prophet Noble Drew Ali was clear about his political, theological and philosophical directions in his treatise the Holy Koran Circle Seven, so I am challenging the Muurs to up their demands and quest, as well as affirmation towards the legal mandates to permanently and legally declare the so-called American Negro a recognized nationality within the United Nations in order to have a place amongst the body of other sovereign nations.

We have to move beyond all these theoretical arguments into establishing a political international law plan of action and become proactive in transitioning us towards claiming our rightful nationality and sovereignty (beyond the rhetoric). Thus, are we prepared to petition the United Nations (which will entail charging the United States Government and other European powers with war crimes against humanity) and wage the legal defense from the international jurisprudence side and work to acquire the monetary resources to wage this monumental legal battle in order to make us legally whole again. This will entail a defense that will tear at the very core and root of the United States Constitution and cause for having some of the best legal minds to frame and defend this argument, which will involve reinterpreting the 13th, 14th, and 15th Amendments to the U.S. Constitution. This will lead to relinquishing our 'American' nationality and debunking our so-called ‘American citizenship’ classification status and overturning the Dred Scott Decision and truly declaring ourselves in name and principle free from the bondages of white supremacy.

So? Modern day niggers benefit from the work their ancestors did too. Maybe they ought to be made to pay reparations too?

I should not dignify this type white supremacy thought. Just imagine this they kidnapped over 100 million Africans who were forced to labor for 310 years. This is typical white denial like Minister Malcolm X stated they have a tendency of making the victim the criminal and the criminal the victim. No, you have to put forth a better argument than reverse racism.

In the English lexicon, the term Moor is defined amongst others as being "dead". Why African peoples wish to define themselves by this term is akin to them calling themselves, "nigger(s)". The usage of the term Moor further attempts to erase the historical fact that these people who "conquered the Iberian Peninsula were Black Africans.

It is my opine that until the Black race unshackles itself from both the Abrahamic religious mythos and Eurocentric Masonic belief systems which both point to the Hebrew as their points of spiritual origin, our people will never be free. In an anachronistic fashion, the former (Abrahamic religious mythos) places the Black African in the position of being cursed because it's progenitor, Abraham, raped an Ethiopian who was his slave, Hagar. The later places another Hebrew centric belief system (Solomon and Hiram Abiff) at it's center even though it was Imhotep who developed the Craft. Why our African brothers and sisters follow either one needs to be examined, addressed and changed.

We can continue to whine and complain about what others have done or are doing to our people OR, we can begin to truly educate our people in a truthful manner in a effort to awaken that light which has been extinguished through the religious mythos of Judaism, Christianity and Islam along with European Free Masonry.

Thanks for your blog and the information you share.

Peace, I think this was a fair assessment whether or not I agree with every point is not the issue, but these type conversations, which is rooted in history, theology, culture and philosophical thought (your argument is well received and is necessary)—I am open to expanding the conversation relative to trying to understand our past and present predicament from various ideological perspectives. Thus, some 460 years later, we are still in search of an identity and our experience speaks to us not solely being a monolithic people (African people are a very diverse people even when it comes to religion)—we are a people that has been robbed culturally, of land and historical dispossessed people due to Chattel Slavery. Our search for identities cultural and historical linkages were acerbated because of the collective dehumanization process posed on our people by slavery (this cannot be overlooked), which has left and created systemic social, political and economic issues that still plague so-called African people to this very day.

I think many of us seek to connect our story to the three Abrahamic faith traditions more as an affirmation of being a dispossessed people who were robbed of our God, land, language, religion, culture, sacraments, rites, customs, etc.; this inhumane assault and African societal disruptions created a void in which race leaders, as well as black movements and organizations evolved that sought various ideologies as solutions to a landless people and oppressed people (some our leaders put forth various religious, political and cultural models as redress strategies and tactics). Some as early as the 1800s begin to maintain that so-called African Americans had direct descent lineages to the original Biblical Hebrews and these original Israelite movements are still ongoing and they are respected by me.

Yet, the black specific Islamic movements have also been around also since the 1800s in which some say the first Africans who were brought to the Americas before the 1913 Moorish Science movement and Prophet Drew Ali were Muslims. Many such as Marcus Garvey approached our dilemma with a more secular and political approach relative to seeking our quest for liberation. I will not dismiss any of them because we are still at an identity struggle and I am willing to listen to them all.

"Moor" does not refer to "Dead" in the English Lexicon. This is an absolutely false statement and silly to even make this claim. "Negro" is the word you are referring to as meaning as "Dead". I am of the ilk that "MOST" so-called "Black" folk did not come here as slaves from Africa, but were enslaved (prisoners of war) on their own lands right here in the Americas. The Olmec, Washitaw, Lenape, the Black Californians were all here long before any European step foot in this part of the world.

People need to research the history of what actually went on right here in America and stop looking at Africa for every thing. We occupied the 4 corners of the globe. They cannot send us back to Africa because our homeland is the Americas. So they house us in prisons.

How can a country thats only 241 years old have slaves for over 400 years? And the word slave doesn't apply to us it applies to slavic women who were sold in Moorish Harems in Spain. What we are looking for is right here...this is the reason most of us cannot trace our linage back to Africa.
They have been lying to the world. But the gig is up. Question. Why is it that almost a 1000 years of Moorish rule in Europe is completely left out of schools all over the world. 1000 years?! Because it would tell you who we really are and who they really are...and the fact that we were always here and owned the land.
